Anatolie Minciună, former judge of the Chisinau Court of Appeal, was referred to the Vetting Commission for evaluation by Parliament as a candidate for the position of member of the Superior Council of Magistracy (SCM) from among non-judges, pursuant to the decision of the Legal, Appointments, and Immunities Committee on 14 November 2023. The Vetting Commission assessed him based on the integrity criteria established in Law 26/2022.
The candidate was invited to a public hearing on 12 June to clarify the integrity doubts identified by the Vetting Commission. Following a postponement at the candidate's request, the hearing was rescheduled for 18 June. On that day, the candidate notified the Commission by e-mail that he would not attend the hearing. Therefore, according to the provisions of Article 12 para. (3) of Law 26/2022, if the candidate refuses to attend the hearing, the hearing will continue in his absence and the evaluation will be based on the information gathered by the Commission during the assessment process and from written communication with the candidate.
The Commission will issue a decision as soon as possible, but usually within one month from the date of the hearing.
📜The evaluation of candidates for the positions of members in the self-administration bodies of judges is carried out based on the following principles:
a) independence of the Evaluation Commission;
b) fairness of the evaluation procedure;
c) publicity of the acts issued in the evaluation process;
d) exceptional nature of the evaluation.
