Out of the 40 judges of the Chișinău Court of Appeal, notified about the start of their external evaluation, 20 have submitted to the Vetting Commission the completed forms of Declaration of Assets and Personal Interests for the last 5 years, Declaration on the list of close persons in the judiciary, prosecution, and public service, as well as the Ethics Questionnaire.
On April 11, 2024, the Vetting Commission notified the judges of the Chișinău Court of Appeal (CCA) regarding the commencement of the evaluation of their financial and ethical integrity according to the provisions of Law 252/2023. The deadline for submitting declarations as provided by law is 20 days. Considering that May 1 was a holiday, this deadline expired yesterday, May 2. After processing the correspondence with the subjects, the Commission announces that it is entering the next stage of evaluation, namely the data collection stage, with 20 out of the 40 notified CCA judges.
In the period ahead, the Commission will collect information relevant to the assessment with immediate access to information systems containing the data needed for the verification process and will request information from public and private entities. The Commission may also receive and analyze information submitted anonymously concerning subjects or other persons involved in the assessment, provided that it is specific, relevant and sufficiently substantiated to be verified. During the question-and-answer sessions, the subjects of the evaluation are encouraged to provide relevant arguments to clarify the integrity issues under consideration by the Commission.
The evaluation subjects will be examined by the Commission in two panels of three members, as established by Law 252/2023. During the evaluation process, the Vetting Commission may use the information about the evaluation provided by the Commission set up on the basis of the Law 26/2022 on measures related to the selection of candidates for the positions of members in the self-administration bodies of judges and prosecutors.
