The Vetting Commission has established the panels responsible for evaluating judges of the Courts of Appeal, presidents and vice presidents of courts, as well as other subjects, in accordance with Law252/2023. The panels' responsibilities are identical to those of the Commission and focus on the external evaluation of the ethical and financial integrity of the subjects.
The six members of the Commission have been divided into two panels, each consisting of three members, referred to as Panel A and Panel B. Each panel includes both national and international members, ensuring representation from both categories.
The structure of the evaluation panels is as follows:
The Chair and Vice Chair of the Commission will lead the panel meetings, hearings, and will sign the reports and documents related to the evaluation process. The quorum for the panel consists of all three members, and decisions must be taken unanimously. If unanimity is not achieved, the evaluation report will be reviewed by the entire Commission.
Evaluation files will be distributed randomly between the two panels. In cases of conflicts of interest, the Commission has the competence to reassign the file or adjust the panel composition as necessary. The Commission also reserves the right to modify the panel composition depending based on workload.
To ensure transparency and impartiality of the process, any recusal of a panel member will result in the reassignment of the file to the other panel. If reassignment is not feasible due to additional recusals or for process efficiency, the recused member may be temporarily replaced. Files will be assigned to rapporteurs on a rotational basis according to established procedures.
The Vetting Commission informed the 18 judges of the Chișinău Court of Appeal, the first subjects notified about the commencement of the evaluation under Law 252/2023, regarding the formation of the two evaluation panels and the panel to which they have been assigned.
