First evaluation reports on the integrity of judges from the Central Court of Appeal submitted to SCM

The Judicial Vetting Commission has submitted three evaluation reports to the Superior Council of Magistracy (SCM) regarding the integrity of three judges from the Central Court of Appeal, formerly the Chișinău Court of Appeal. These reports are the first ones adopted under Law 252/2023, which regulates the external evaluation process of judges and prosecutors.

According to the reports, the Commission recommends that Judges Victoria Sîrbu, Marcel Juganari, and Denis Băbălău pass the evaluation. The three judges were interviewed in February by one of the two panels established within the Commission for evaluating appellate court judges, as well as other subjects in accordance with Law 252/2023. Judges Victoria Sîrbu and Marcel Juganari were assessed by Panel B, composed of members Scott Bales, Willem Brouwer, and Iurie Gațcan. Judge Denis Băbălău was evaluated by Panel A, consisting of Andrei Bivol, Lavly Perling, and Lilian Enciu.

Once approved, the reports were submitted to the subjects concerned and the SCM, which will review them and make a decision. According to legal provisions, the SCM has two options:

  • Accept the report;
  • Reject the report and order the re-evaluation process.

At this stage, the reports are not published. Only the evaluation results are made public on the website of the Judicial Vetting Commission, under the "Subjects" section.
