Two evaluation reports concerning judges from the Central Court of Appeal, submitted to the SCM

The Judicial Vetting Commission has concluded the evaluation process for judges Ana Panov and Silvia Cecan from the Central Court of Appeal. Today, the Commission submitted the evaluation reports of the two judges to the Superior Council of Magistracy (SCM) for examination.

According to the conclusions formulated in the reports:

▪️The Commission proposes that judge Ana Panov should pass the evaluation;

▪️The Commission proposes that judge Silvia Cecan should fail the evaluation, as she does not meet the integrity criteria provided by Law 252/2023.

After their submission, the reports are subject to examination by the SCM in a public session, where the Council will decide whether to accept or reject the conclusions formulated by the Commission. The reports have also been communicated to the judges concerned.

At this stage of the process, in accordance with the interpretation provided by the Constitutional Court, the evaluation reports are not made public. Only the outcome of the evaluation is published on the Commission’s website under the “Subjects” section. The reports will be made public within three days after the expiration of the period for contesting the SCM’s decision or following a final ruling by the Supreme Court of Justice.

Current evaluation status at the Central Court of Appeal

Of the 18 sitting judges of the Central Court of Appeal subject to external evaluation under Law 252/2023:

▪️9 judges have received a recommendation to pass, with reports submitted to the SCM;

▪️5 judges have received a recommendation to fail, with reports submitted to the SCM;

▪️evaluation reports for 4 judges are currently being drafted.

Of the 14 reports submitted thus far to the SCM, three have been reviewed and accepted as promotion reports. One case was returned to the Commission for reevaluation. The examination of one case was postponed, while in another, the examination period was extended.
