The rules according to which judges of courts of appeal, presidents and vice-presidents of courts and other subjects will be evaluated have been approved,Law 252/2023

The Vetting Commission informs that it has amended its Rules of Organization and Functioning to regulate the procedure for the evaluation of judges of courts of appeal, presidents and vice-presidents of courts, including those who have been acting in these positions for a term of more than one year, as well as the candidates who will win the competitions for these positions until 31 December 2025, according to Law 252/2023.

The amendments to the Rules detail the evaluation procedures and criteria applied. Thus, in the evaluation of subjects under Law 252/2023, two evaluation panels of three members will be established, representing both national and international members. One panel will be chaired by the Chairperson of the Commission and the other by the Vice-chairperson.

Evaluation files will be randomly assigned to the evaluation panels. Files may be reassigned from one panel to another if required because of the recusal of a panel member. The amended Regulation also addresses issues related to recusals and the evaluation criteria of ethical and financial integrity of the subjects. To ensure transparency and fairness of the process, clear procedures have been established for the initiation of the assessment, the collection of relevant information and the organization of public hearings, ensuring that the right of defense of the subjects is respected and that measures to protect confidential information are in place, as appropriate.

The amendments to the Rules reflect the Vetting Commission's commitment to ensure that its work complies with the legislation in force and the fundamental principles of the rule of law.

The updated Rules has been published, in Romanian and English, on the Commission's website www.vetttingmd.eu A copy of the Rules will be sent to the subjects to inform them in advance about the evaluation procedure.
