The Vetting Commission will evaluate the new group of candidates proposed by the Parliament for the position of member of the Superior Council of Magistracy (SCM).

The Vetting Commission has received for evaluation the list of five non-judge candidates proposed by the Parliament for the position of member of the Superior Council of Magistracy. These candidates are to undergo assessment by the Vetting Commission, given that Law No. 252/2023  on the external evaluation of judges and prosecutors, which regulates the Commission's activities, stipulates that candidates participating in the competition for the SCM after September 1, 2023, are to be evaluated by the Vetting Commission.

The five non-judge candidates for the position of SCM member, whose financial and ethical integrity will be assessed by the Vetting Commission, are:

·       Vitalie Ciuchitu - lawyer;

·       Sergiu Băieşu - head of the Private Law Department at the State University of Moldova (USM);

·       Tatiana Tabuncic - member of the Integrity Council;

·       Ion Rusu - lawyer;

·       Anatolie Minciuna - former president of the Court of Appeal Chișinău.

The Commission will analyze and determine, based on Law 26/2022, whether the candidates have exhibited behavior compatible with professional ethics throughout their activity, whether they have  admited conflicts of interest, whether they have properly declared their assets, and whether these assets correspond to their incomes.

Note: Among the case files of candidates who submitted their candidacy to the Parliament, but not received by the Vetting Commission, there are three individuals who have previously undergone the verification process of the Pre-Vetting Commission and have successfully passed the evaluation. They will not be evaluated repeatedly by the Vetting Commission. These are: Aliona Corcenco - former judge at the Court of Appeals Bălți; Veaceslav Guțan - former university lecturer at the Police Academy "Ștefan cel Mare"; Leonid Chirtoacă - lawyer.

The Vetting Commission is an independent commission that currently conducts the extraordinary assessment of the integrity of the judges of the Supreme Court of Justice (SCJ) and candidates for the position of SCJ judge, in accordance with the provisions of Law No. 65/2023, and other subjects as stipulated by Law No. 26/2022 and Law No. 252/2023.
